  • Representation in all phases of affiliations, joint ventures, mergers, etc.
  • Representation regarding CON’s from initial application to license surrender
  • Drafting of staff bylaws; policies and procedures
  • Provision of consultation and advise for day to day practice/facility issues

Managed Care Contracting/Credentialing

  • Representation of providers in credentialing matters with facilities and/or payors
  • Representation of facilities with regard to drafting credentialing policies and procedures
  • Representation of facilities and individual providers with credentialing difficulties
  • Review and negotiation of managed care contracts
  • Representation with regard to payor (private and governmental payors) and retractions; requests for repayment

Fraud and Abuse/Compliance

  • Drafting of compliance plans, policies and procedures, and related documents
  • Drafting of staff training and educational materials
  • Representation with regard to HIPAA; including breaches and reporting issues
  • Representation with regard to third-party investigations (OIG, OMIG, FTC, etc.) and subpoenas, etc.
  • Representation for self-disclosures to government agencies; exclusion issues
  • Review and negotiation of Corporate Integrity Agreements; filing Implementation Reports

Management Issues (Facility and Practices)

  • Representation of all providers and facilities regarding patient issues, HIPAA and, medical records issues
  • Representation of all providers and facilities with regarding medical staff issues including disruptive staff, coordination with the Committee for Physicians Health
  • Representation of providers and facilities in investigations and corrective action procedures
